Please review these Terms carefully before using the Application or Services. We may change these Terms or modify any features of the Application at any time. The most current version of the Terms can be viewed by clicking on the "Terms of Use" link posted through the Application. You accept the Terms by using the Application or Services, and you accept any changes to the Terms by continuing to use the Application or Services after we post the changes.

The Application is intended to facilitate the provision of services to registered users. Basic Benefits, LLC does not provide healthcare services directly. Basic Benefits, LLC's digital health tools are designed to assist but do not provide medical diagnosis, advice, or treatment. You should always consult with your physician before making any medical decisions, including starting, stopping, or modifying any medication or care plan.

The Application enables Healthcare Providers to offer an online telehealth service that, when clinically appropriate, allows patients to obtain a limited range of healthcare from participating Healthcare Providers. Based on the information you provide, a Healthcare Provider will provide a diagnosis and a treatment plan for you.

If you register to receive healthcare services through the Application, we rely on you to provide accurate and complete information to ensure you receive appropriate care.

Application Disclosures

Important information about your use of the Application: DO NOT USE THIS APPLICATION OR SERVICES FOR EMERGENCY MEDICAL NEEDS. If you experience a medical emergency, call 911 immediately.

This Application and Services ARE NOT appropriate for all medical conditions or concerns.

This Terms of Use & End-User License Agreement ("Terms") is a legal agreement between you, the customer, and Basic Benefits, LLC, regarding the license, access, and use of the Application (as defined in these Terms). In these Terms, "you," "your," and "yourself" refer to you, the customer, and "we," "us," and "our" refer to Basic Benefits, LLC.

Basic Benefits, LLC does not provide clinical services. All Healthcare Providers are independent of Basic Benefits, LLC and are merely using the Application to communicate with you. Any information or advice received from a Healthcare Provider comes directly from that provider, and not from Basic Benefits, LLC. You agree that you are entering into a separate agreement with the provider of medical services to you.

NEITHER BASIC BENEFITS, LLC NOR ANY OF ITS LICENSORS, SUPPLIERS, OR THIRD PARTIES WHO PROMOTE THE APPLICATION OR PROVIDE A LINK TO THE APPLICATION OR SERVICES SHALL BE LIABLE FOR ANY PROFESSIONAL ADVICE OBTAINED THROUGH THE SERVICE. YOU ACKNOWLEDGE THAT YOUR RELIANCE ON ANY PROVIDERS OR INFORMATION PROVIDED THROUGH THE SERVICES IS AT YOUR OWN RISK.

Basic Benefits, LLC does not make any representations or warranties regarding the qualifications or skills of any Healthcare Providers using the Application.

Important:

By installing and/or using the Application, you represent and warrant that you are eighteen (18) years of age or older AND possess the legal right and ability to agree to these Terms of Use on behalf of yourself or a minor child of whom you are a parent or legal guardian. By agreeing to these terms, you also agree to our Informed Consent and Privacy Policy.

If you do not accept these Terms, you are not permitted to use the Application. Basic Benefits, LLC reserves the right to change these Terms or modify the Application features at any time, and your continued access or use of the Application after such changes constitutes your acceptance of those changes.

SECTION 01: Certification of Location

To use the Application and Services, you must be located in a jurisdiction where the Services are available. You certify your location each time you use the Services.

SECTION 02: Data Protection

Any personal information (including health information) you provide when using the Application will be used in accordance with our Privacy Policy, which is available here: www.basicbenefits.net/privacy-policy.

SECTION 03: Application Content

You should not consider content on the Application to be medical advice, except for the personalized content provided by your Healthcare Provider.

SECTION 04: User Accounts

When you register, you will create an account ("Account") by entering your name, email address, and password. You are responsible for maintaining the confidentiality of your Account password and all activities under your Account. You must notify us if you believe your username or password has been compromised. We reserve the right to revoke or deactivate your Account at any time.

SECTION 05: Security

Basic Benefits, LLC has implemented encryption and security measures to protect your personal information. However, no system is completely secure. We maintain standard safeguards to limit access to your personal information to those who need it for business purposes.

SECTION 06: Communications Consent & Communication Risks

Using the Application involves inherent risks such as data breaches or miscommunication. You consent to electronic communication with us and our Healthcare Providers, and you accept the risks of such communications.

SECTION 07: Informed Consent

By using the Application, you are consenting to receive care via the Application and have read and agreed to the Informed Consent. The healthcare provider will determine whether the condition being treated is appropriate for telehealth.

SECTION 08: Proprietary Rights and License

All intellectual property rights in the Application are owned by Basic Benefits, LLC or its licensors. You are granted a non-exclusive, revocable license to use the Application for personal purposes, subject to these Terms.

SECTION 09: Conditions of Use

You agree not to copy, reproduce, alter, or reverse engineer the Application. You may not use the Application in violation of any laws or regulations.

SECTION 10: Payment

If you purchase products or services through the Application, you agree to pay all applicable fees. Payments are processed by third-party providers and are non-refundable.

SECTION 11: Limitation of Liability

To the fullest extent permitted by law, Basic Benefits, LLC is not liable for any indirect or consequential losses arising from your use of the Application. Your use of the Application is at your own risk.

SECTION 12: Disclaimer of Warranties

The Application is provided "as is" without warranties of any kind. Basic Benefits, LLC makes no representations or warranties about the accuracy or reliability of the Application or its content.

SECTION 13: Termination

Basic Benefits, LLC may terminate your access to the Application at any time. Upon termination, you must cease all use of the Application.

SECTION 14: General
